A trade mark is a sign that distinguishes the goods and services of a business from others. Typically a trade mark can be words (including personal names), indications, designs, letters, characters, numerals, figurative elements, colours, sounds, smells, the shape of the goods or their packaging or any combination of these.

Note

For a sign to qualify as a trademark, it must be representable in a graphical form to be eligible for registration.

What is the Duration of Trademarks?

Duration

  • ​In Hong Kong, a registered trade mark is initially registered for 10 years.

  • The registration of the trade mark can be renewed for further periods of 10 years each, with the payment of renewal fees.

  • The registration of a trade mark can therefore last indefinitely if it continues to be renewed.

Note

A registered trade mark may be challenged in revocation proceedings if it is not used in Hong Kong for a continuous period of 3 years.

Nice Classification

  • In Hong Kong, goods and services are classified in accordance with the Nice Classification.

  • There are 45 classes under the Nice Classification.

  • A trade mark application must indicate the classes of goods and services that the trade mark will be identified with.

What You Need to Provide
to Register a Trademark?

To register a trademark in Hong Kong, you need to provide:

  • Copy of HKID of the trademark owner (For individual owner) / Copy of Business Registration Certificate of the trademark owner (For corporate owner)

  • Details of the applicant (e.g. correspondence address in Hong Kong, telephone number, email address)

  • Trademark graphic (If the colour is an element of a trademark, it is necessary to include the specific color in the trademark description)
